Making an Offer
Once you’ve found the right property, you’ll instruct your solicitor to submit an offer – on your behalf – to the seller’s solicitor.
Offers in Scotland are submitted in writing. Verbal offers or agreements are not legally binding.
Your solicitor will need to know:
- the price being offered
- how the purchase is being funded e.g., mortgage, savings
- your proposed date of entry
- any extras you want included in the deal.
These are all important details to include in the written offer.
The offer will normally comprise what is known as the Scottish Standard Clauses. A copy of these can be found on the website of the Law Society of Scotland.
